These Terms of Service ("Terms") govern your use of the Battle Born Smokers catering inquiry website at renobbqcatering.com ("Site") and any catering services provided by Battle Born Smokers ("we," "our," or "us"). By submitting a catering inquiry through this Site, you agree to be bound by these Terms.
1. Use of This Site
This Site is provided solely for the purpose of submitting catering inquiries to Battle Born Smokers. You agree to use this Site only for lawful purposes and in accordance with these Terms. You must not use this Site in any way that could damage, disable, or impair the Site or interfere with any other party's use of it.
2. Catering Inquiries
Submitting a catering inquiry through this Site does not constitute a binding contract or reservation. All catering engagements are subject to the execution of a separate written catering agreement between you and Battle Born Smokers. Availability is not guaranteed until a signed agreement and required deposit have been received.
3. Accuracy of Information
You agree to provide accurate, current, and complete information when submitting a catering inquiry. Battle Born Smokers relies on the information you provide to prepare quotes and plan services. Inaccurate information, including incorrect guest counts or event details, may affect the quality and scope of services provided and may result in additional charges.
4. Final Guest Count
A final confirmed guest count is required no later than eight (8) days prior to the event date, as indicated on your catering agreement. Failure to provide a final count by this deadline may result in service adjustments or additional fees. Battle Born Smokers will prepare food based on the final confirmed count and cannot guarantee service for guests above that number.
5. Pricing and Payment
All pricing is provided as an estimate based on your inquiry and is subject to change until a written catering agreement is executed. Final pricing will be confirmed in your catering agreement. Payment terms, deposit requirements, and cancellation policies are outlined in the catering agreement and are binding upon execution.
6. Dietary and Allergen Responsibility
While Battle Born Smokers makes reasonable efforts to accommodate dietary restrictions and allergen concerns disclosed in your inquiry, we cannot guarantee that any menu item is completely free from allergens. It is the client's responsibility to disclose all dietary restrictions and severe allergies. Battle Born Smokers is not liable for allergic reactions or dietary issues arising from information that was not disclosed at the time of booking.
7. Intellectual Property
All content on this Site, including the Battle Born Smokers name, logo, menu descriptions, and design elements, is the property of Battle Born Smokers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from this Site without our prior written consent.
8. Limitation of Liability
To the fullest extent permitted by law, Battle Born Smokers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this Site or from any catering services provided. Our total liability for any claim arising from catering services shall not exceed the amount paid by you for those specific services.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Washoe County, Nevada.
